PP 03 34–JOINT OWNERSHIP COVERAGE

This form allows relatives other than husband and wife (regardless of residency) or unrelated, resident individuals who share an insurable interest in private passenger vehicles to be insured as joint owners. Such persons would then be eligible for full coverage under the Personal Auto Policy.

Siblings who own a car, nontraditional households, roommates, separated spouses are all examples of situations where this endorsement is appropriate.

The Schedule

The endorsement includes a schedule for listing the names of the individuals who are vehicle co-owners. The latter who are partial owners that don’t reside in the same household are listed in a separate area with both names and respective addresses.

Other areas of the schedule are for adding descriptions of the vehicles with multiple owners.

The last area of the schedule refers to whether the form’s Additional Liability Coverage Exclusion is applicable.

Coverage Analysis

The endorsement extends the coverage of a PAP to named individuals who share ownership of the vehicles that are specially described in the form’s schedule. It does so by modifying a Personal Auto Policy’s Definitions and providing an additional exclusion.

I. Definitions

The PP 03 24 includes the following modifications:

A. “You” and “your” is expanded so that it applies to persons who share ownership of a type of vehicle that is eligible for protection under the PAP. The covered vehicle owners may either be persons living in a single household (other than spouses) as well as persons who live in separate households.

B. “Your covered auto” is changed under this form to those vehicles appearing in its schedule, autos acquired (and reported) during the applicable policy period, owned trailers and non-owned trailers that are temporary substitutes.

C. This section adds defined term, “non-resident relative.” It refers to a person who does not live in the named insured’s household but who is related, via blood, wards, adoptees, marriage (ex, in-laws) or foster children.

Note: It seems odd to extend the definition to wards and foster children as it is difficult to imagine such persons NOT being household residents.

II. Part A–Liability Coverage

The form amends Part A of the PAP to elect an option to exclude PAP liability coverage to nonresident relatives (per the form’s definition) as well as their family members (also as defined by the PAP). The exclusion, if selected, applies when such persons are operating vehicles that fall outside the “your covered auto” definition.
